Terms of Service

1. Acceptance of Terms
By accessing or using Pacer (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service description
Pacer is an AI-powered running coach application that generates personalized training plans, analyzes athletic activities, and provides coaching recommendations. The Service integrates with third-party platforms (Strava, Garmin Connect, Apple Health, Google Fit) at your discretion.
3. Eligibility
- You must be at least 16 years old to use the Service
- You must have a valid Google account for authentication
- You must consult a physician before beginning any training program if you have medical conditions
4. Medical disclaimer
Pacer is not a medical device, healthcare provider, or substitute for professional advice.Training plans and recommendations are generated by AI based on your input data. They do not account for all individual medical conditions, injuries, or circumstances.
- Consult a doctor before starting any new exercise program
- Stop exercising immediately if you experience pain, dizziness, or shortness of breath
- You assume all risk associated with using the training plans
- We are not liable for injuries, health complications, or adverse effects
5. User responsibilities
You agree to:
- Provide accurate profile information
- Use the Service only for personal, non-commercial purposes
- Not abuse the API or AI features (rate limits enforced)
- Not reverse engineer, scrape, or systematically extract data from the Service
- Not share your account credentials with others
- Comply with Strava's, Garmin's, and other third-party terms when using integrations
6. Acceptable use
You may not:
- Use the Service for any illegal purpose
- Attempt to bypass security measures or rate limits
- Upload malicious files or attempt to inject code
- Harass, threaten, or impersonate others
- Use automated bots to access the Service
- Resell, sublicense, or commercialize access to the Service without permission
7. Third-party integrations
When you connect Strava, Garmin, Apple Health, or Google Fit:
- Their terms of service apply to your use of their platforms
- You authorize Pacer to read/write data on your behalf as specified during OAuth consent
- You can revoke access at any time from the third party's settings page
- Pacer is not responsible for changes or interruptions in third-party APIs
- Garmin integration uses unofficial API — stability is not guaranteed
8. Pricing & subscriptions
The Service offers a free tier with limited features and paid tiers with expanded limits. Subscription pricing, billing, and refunds are governed by separate subscription terms presented at the time of purchase. Currently the Service is in beta and offered free of charge.
9. Rate limits
To prevent abuse and manage costs, we enforce per-user rate limits on:
- Chat messages per day
- AI token usage per day
- Plan generation per week
- AI model access (free tier limited to faster models)
Limits are subject to change. Exceeding limits will result in temporary access restrictions.
10. AI usage & data
Pacer uses Google's Gemini AI API for conversational coaching responses. Your data flow with AI:
- One-shot inference only: your profile, activities, and chat messages are sent to Gemini API for response generation only. No data is used to train AI models.
- No model fine-tuning: we do not fine-tune, retrain, or otherwise modify AI models with your data.
- No data aggregation for ML: we do not combine user data across athletes for machine learning purposes.
- Strava data handling: Strava activity data is fetched fresh per request and used only for personalized response generation. We do not persist Strava activity data beyond the 7-day API cache permitted by Strava's API Agreement.
- Per-user isolation: AI prompts are constructed from a single user's data only. No cross-user prompt construction.
11. Intellectual property
- You retain ownership of your input data (profile, conversations, plans)
- Pacer's code, brand, design, and AI-generated content templates are owned by us
- You grant us a non-exclusive license to process your data to provide the Service
- AI-generated plans/recommendations are not subject to copyright (per AI output legal status)
12. Account termination
We may suspend or terminate accounts that:
- Violate these Terms
- Abuse the API or AI resources
- Engage in illegal activity
- Are inactive for over 12 months

13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. We do not guarantee:
- Uninterrupted or error-free operation
- Accuracy of AI-generated training plans
- Compatibility with all watches and platforms
- Availability of third-party integrations
14. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim (or €0 if you are on the free tier).
15. Governing law
These Terms are governed by the laws of Poland. Any disputes shall be resolved by Polish courts, except where consumer protection law mandates otherwise.
16. Changes to Terms
We may update these Terms. Material changes will be announced in the app and via email if significant. Continued use after changes implies acceptance.
